Magistrate F Darboe of the Bundung Magistrates’ Court has struck out an assault case against one Abdou Salam Camara for what she called lack of diligent prosecution by the police.
When the case was called yesterday, the police prosecutor First Class Sallah told the court that the last adjourned date for the case was taken by one of his colleagues who took a wrong date. He said the prosecution was not ready to proceed with the case and therefore applied for an adjournment.
Magistrate Darboe however said the accused has been absent in court since 8 December, last year. “The accused has been absent for three consecutive sittings,” she said. She said the court had given two separate warnings to the prosecution to bring the accused to enable proceeding of the case which it failed.
She said there is no reason to keep the matter on the court list without proceeding, saying the prosecution did not show diligence in prosecuting the matter as officers of the court. “Due to the above reasons, this case is hereby struck out for lack of diligent prosecution,” Magistrate Darboe said.
Abdou Salam Camara was alleged of assaulting one Muhammed Camara on 27 October 2016 at Tallinding.
